Russia / Eurasia: Eurasian design

As of June 1, 2021 it is possible to file an application for a Eurasian design at the Eurasian Patent Office (EAPTO). At present (June 1, 2021) protection is possible in Azerbaijan, Armenia, Kazakhstan, Kyrgyzstan and Russia.

An application may comprise 100 designs per class and a maximum of 7 representations (photos, drawings) per design. A description is only necessary for clarification purposes.

One month after completion of the preliminary examination the application is published.

Substantial examination is carried out after preliminary examination.

The EAPTO records the design in the official register once the registration fee has been paid and issues a registration certificate.

Within 6 months from the publication of the registration of the design, third parties may file an opposition.

A Eurasian design is valid for 5 years from the application date and can be renewed upon payment of the renewal fee for further 5 years in all member states. The maximum term of validity is 25 years.
