New Industrial Property Laws in Bosnia and Herzegovina


The following new set of laws on industrial property in Bosnia and Herzegovina has been adopted and is in force since 1st January 2011:

  • Law on Trademarks,
  • Law on Patents,
  • Law on Industrial Designs,
  • Law on Geographical Indications,
  • Law on Protection of Topographies of Semiconductor Products.


The following are the most important changes introduced by this new set of laws:

Law on Trademarks

  • The Bosnian Patent and Trademark Office conducts formal examination and examination as to absolute grounds for refusal of protection of trademark applications.
  • Applications are published, and third parties are entitled to lodge a complaint (based on absolute or relative grounds) within three months from publication of the application.
  • Certificates of Registration are compulsory.

Law on Patents

  • The Bosnian Patent and Trademark Office conducts formal examination and publishes patent applications.
  • Divisional applications are permitted.
  • Within six months from the publication, the applicant must file one of the following     requests:
  • for substantial examination (which is  conducted by the Office or in cooperation with approved authorities),
  • for substantial examination by filing documents of evidence (which are issued by approved PCT- or other authorities),
  • for deferring substantial examination and obtaining a consensual patent.
  • Requests for obtaining consensual patents are published, and third parties are entitled to lodge a complaint within six months from publication of such request.
  • Consensual patents are valid for 10 years (from the filing date); during this period a request for substantial examination can be filed at any time.
  • Patents which underwent substantial examination are valid for 20 years (from the filing date).
  • Certificates of Registration are compulsory.
  • Supplementary Protection Certificates for patents are permitted.


Law on Industrial Designs

  • The Bosnian Patent and Trademark Office conducts formal examination and examination     as to absolute grounds for refusal of protection of industrial design applications.
  • Applications are published, and third parties are entitled to lodge a complaint (based on absolute or relative grounds) within three months from publication of the application.
  • Divisional applications are permitted.
  • Certificates of Registration are compulsory.
  • Designs are initially registered for five years and can be renewed four times by a five-years period (i.e. the maximum term of validity is 25 years).
